This is an example of a tie-break in which the right player is selected as the winner. So it does not always go wrong.

But what's the clue then?

Another example in which it did work properly.

Could it be that it is implemented not who is the player to take the final 1 or 2 cards, but the player who is the last to take his/her FIRST cards, for example? Or that something goes wrong in registrating who takes the final card(s)?
